All business relationships between customers and partners (hereinafter referred to as “Users”) and Neocleus AG (hereinafter referred to as “Neocleus”) are governed exclusively by these General Terms and Conditions (GTC), including the Terms of Use. By using the relevant services, the respective Users declare their agreement with the GTC and Terms of Use. The GTC apply exclusively; deviating or conflicting provisions are not recognized by Neocleus unless express written consent has been given.
Object
360-Talents is a service provided by Neocleus AG. 360-Talents provides recruitment and consulting services. The personnel diagnostics service enables clients to carry out diagnostics to assess soft skills. The services are provided in close cooperation with our scientific partner Swiss Connect Academy Deutschland GmbH, the Swiss cloud server Nine Internet Solutions AG and the payment service provider (PSP) Datatrans AG. Users acknowledge and agree to cooperations with partners by using the services offered by Neocleus and grant our platform the right to provide the partners with the necessary information and data of the users for the provision of our services.
Terms of use
a) Scope of application
The subject of these Terms of Use is the use of services provided by Neocleus on the 360 Talents platform. These terms of use apply to all users of the platform, regardless of their role as a private company, public company or private individual. Consent to the terms of use is given by using the corresponding services. When using individual services on the platform, the user may be asked to repeat their consent to the terms of use by activating a corresponding input field. These Terms of Use apply for the entire duration of the user's use of the platform's services.
b) Functionality of the platform and services of 360-Talents
The 360-Talents service enables users to carry out personnel diagnostics to record soft skills. The diagnostics are carried out in cooperation with our scientific partner Swiss Connect Academy Deutschland GmbH. Neocleus may add to or change the services at any time. The user selects the service to be provided by Neocleus from the range of services available at the time of use. Users can use the services as a private company, as a public company or as private individuals under the conditions defined in these Terms of Use.
c) Obligations of the users
Neocleus must be informed immediately by e-mail of any access errors or malfunctions that occur in connection with the services provided by 360-Talents so that they can be rectified. Access errors or faults will be rectified within a reasonable period of time.
d) Conditions and terms of payment
The prices shown on the 360-Talents website are exclusive of the applicable VAT. The prices quoted are binding for the contracting parties. Any discounts may be granted within the framework of special promotions and recorded directly during the payment process. Payment is processed before the selected service is used. Private and public companies may deviate from this principle and individual agreements may be made. A subscription lasts at least 6 months (monthly price plan) and can be terminated at any time at the end of the contract period. If no notice of termination is given, the subscription is automatically renewed for a further 6 months (monthly price plan) or 12 months (annual price plan).
e) Disclaimer
Neoceus accepts no liability for the improper use of our services, such as the entry of false or untrue information. Neocleus rejects any liability for failures and other events that are beyond our control. Furthermore, Neocleus excludes all claims in connection with the platform to the greatest extent possible by law, in particular for damages due to transmission errors, technical defects, interruptions or malfunctions. Uninterrupted or error-free operation of the platform is not guaranteed. If the platform cannot be used temporarily because it is adapted, supplemented or changed or if malfunctions occur, Neocleus accepts no liability. This does not affect the customer's obligation to pay.
f) Data protection
Regarding data protection, we refer to the relevant section under "Data Protection". By accepting these terms of use, the user also agrees to the provisions of the privacy policy.
g) Final provisions
Should one or more provisions of these Terms of Use be void or invalid, this shall not affect the validity of the remaining provisions. The void or invalid provision shall be replaced by one that comes closest to the purpose of the void or invalid provision.
h) Jurisdiction and Applicable Law
Subject to a mandatory place of jurisdiction, the courts at the registered office of Neocleus AG shall have jurisdiction for all questions arising from or in connection with the Terms of Use or the Platform. Swiss law applies (with the exception of conflict of laws rules).
At 360-Talents, we strive to provide our users with a high-quality experience and place great importance on your satisfaction with our application. We understand that sometimes things don't work as expected, which is why we offer a 7-day return policy.
If you are not completely satisfied with your purchase within the first 7 days of your subscription, you are entitled to a full refund. To request a refund, please contact our support team by emailing us at info@neocleus.ch . Provide us with your account details and the reason for your refund request, and we will process your refund promptly.
Please note that refund requests must be submitted within 7 days from the start date of your subscription. Refunds will be returned to your original payment method and are usually completed within 5-10 business days, depending on your bank or payment provider.
